Maybe dementia that now has Joe Biden firmly in its grasp had actually been with him since 1990.
In that year, an amendment to the constitution was voted on to making the desecration of the American flag illegal. Biden fought against the amendment.
His reasoning was that if you made it illegal to burn the flag, you could also prosecute two homosexuals if they were to engage in sex on the flag as well. Biden has not gotten any smarter, proving Ron White’s theory that you just can’t fix stupid. You can’t even patch it.
Biden said:
“Parts of the American public occasionally responding to the emotions of the moment; occasionally, occasionally, they pass laws that don’t make sense in the wide scope of things.”
“We went through a whole exercise here with Mapplethorpe’s paintings and the National Endowment for the Arts, and they related to paintings – photographs that had to do with homosexual activity. I ask you, assume that there were a painting or a photograph taken of homosexuals engaging in a sexual act on a flag.”
Biden argued a constitutional amendment would be the gateway to regulating expression. He said:
Would that be desecrating the flag under this amendment? Let me ask you, does anyone doubt that there might not be at least a few members of this body that would introduce an amendment to the law? We can amend this 99 times, once we pass the constitutional amendment, we can pass any law we want.
There can be 1, 2, 7, 10, 20, 50, 70, 100 such laws. Does anyone in here doubt that the next day there wouldn’t be someone here with a statute saying it is, by definition, desecration of the flag to portray it in a circumstance where homosexual activity is being performed upon the flag? Or heterosexual activity. And let’s decide then we get into it.
Biden later claimed that he didn’t want anyone doing anything on the flag but that he didn’t think it should be criminalized.
