We will be offering some bonus podcast content this week, as there is so much going on in the lead-up to next Monday’s Supreme Court oral argument on Harvard/UNC affirmative actions admissions cases. We might even have a few episodes of the 3WHH on some loose ends from last week’s show to answer listener questions.

This is the first and most important episode. John Yoo and myself hosted Richard Epstein, a distinguished legal scholar, for a lecture at Berkeley Law last February. Given that we were still subject to a mask mandate, Richard decided to discuss our COVID misadventures, which are a prime example the administrative state running amok. As we do every time, we uploaded the lecture to the law school’s YouTube channel.

YouTube removed Richard’s talk video from YouTube a few days ago on the ground that it violated YouTube’s terms and service regarding spreading “misinformation” about COVID. Here’s the URL of the university’s Public Law and Policy Program website:

Let this sink in: YouTube, the home of modern “free speech”, has decided to play its Big Brother role to death. YouTube informs us that we have a “Community Guidelines Strike” on our records and a one week probation period during which YouTube prohibits us from streaming any events or posting new content. We also have an Ilya Shapiro lecture in the can, and it is ready to go.

It is obvious that the minimum response is to share this lecture with our listeners. So here it is. Keep checking back for more updates.
