Next Monday, the Supreme Court will hear the affirmative action admissions cases against Harvard and University of North Carolina. But, before we get to the constitutional doctrine of this matter, there is an important question that many people overlook: If we are going to be giving racial preference for admissions (and government contract), who counts as a member of what minority group? David E. Bernstein’s new book Classified – The Untold Story Of Racial Classification in America explores the government’s racial classifications.

Prof. Bernstein discusses some of the major milestones and confusions in this sordid enterprise and answers my questions in this lecture he gave recently at Berkeley Law. Listen to the lecture, but make sure you get a copy of his book. Despite the complexity of the issue, it is short and easy to read.
