The Department of Justice has asked the United States Court of Appeals, Fifth Circuit to stop depositions of important officials from the Biden administration.
POLITICO has obtained court documents that show that the Department is asking for the court to cancel an order allowing the depositions by Surgeon General Vivek Muthy, Director, Cybersecurity and Infrastructure Security Agency Jen Easterly and Deputy Assistant to President and Director, White House Digital Strategy Rob Flaherty.
The motion did not include Dr. Anthony Fauci or Jen Psaki, former White House press secretary.
An earlier lawsuit was filed by Jeff Landry, the Louisiana Attorney General and Eric Schmitt, Missouri Attorney General. They accuse prominent Biden officials in the case of conspiring with Big Tech companies in order to censor content to stop the spread of misinformation.
NewsBusters reported last Wednesday that the court ordered the depositions of Biden officials in the lawsuit. This could have a lasting effect on free speech online.
The court’s order granting deposition requests
“Plaintiffs have shown that Dr. Fauci is intimately familiar with the issue of censorship on social media in relation to COVID-19, and other ancillary issues. The Court has recognized that Dr. Fauci is a high ranking official, particularly since he is the Director of National Institute of Allergy and Infectious Diseases and Chief medical advisor to the President. According to the Court, Dr. Fauci’s only potential burden as a result his deposition is that of his time.
In the lawsuit, the lawsuit specifically cites original research by Media Research Center and its CensorTrack databank.
April saw MRC Free Speech America publish its findings in CensorTrack, which tracks pro-Biden censorship from March 10, 2020 to March 10, 2022.
MRC also found Big Tech’s censorship in stories about the Hunter Biden scandals, which were covered by the New York Post, contributed to Joe Biden winning the 2020 presidential election.
