Francisco’sanctuary policies’ prevent ICE interviewing Pelosi attack suspect San Francisco’s “sanctuary” policies, which prohibit cooperation with Immigration and Customs Enforcement(ICE), forbid federal immigration authorities from interviewing the suspect in attacking Nancy Pelosi’s husband. Fox News received information from ICE that the San Francisco Sheriff’s Office denied ICE officials permission to interview David DePape. DePape is a Canadian illegal immigrant accused of attacking Paul Pelosi at his California home with a hammer. Fox was directed by an ICE spokesperson to inquire about the policies of local officials. Fox News Digital was informed by the San Francisco Sheriff’s Office that a person presenting himself as an immigration official arrived at jail Oct. 31 with a card and no government credentials. The individual was denied entry to the jail. After the article was published, a spokesperson stated that the person was turned down due to lack of government credentials. However, they would likely have been denied entry to jail if they had provided any credential if they were involved in civil immigration enforcement. Last week, the Department of Homeland Security confirmed that DePape had entered the U.S. legally from Mexico on a visitors visa issued in 2008. He had entered Canada on a B-2 visa which allows Canadian visitors to stay up to six months. The visa was then allegedly extended to him. This includes access to inmates logs, arrest documents and release dates, as well as access to home or work contact information. Fox News Digital was informed by Tara Moriarty, Director of Communications at SFSO, that ICE employees are not allowed to enter the jail unless they have a criminal warrant. “ICE is not granted access to jail by our deputies, and employees are not authorized for civil immigration enforcement.” PAULPELOSI ATTACK GRAND JURY DAVID DEPAPE INDICTED AFTER ALLEGED HAMMER ASSAULT Jon Feere, a former chief of staff at ICE during the Trump administration, stated that it was “standard practice for ICE” to interview illegal immigrants in jail to determine the next steps in an immigration case and that this can provide ICE important information. Fox News Digital’s he said that ICE is limited in what it can see in its records, and that the person’s circumstances might have changed since their last interaction. “ICE sees the fingerprints of aliens arrested by local law enforcement when they deal with our electronic systems. A face-to-face interview can confirm many things. He said that you can never predict what you might find out during an interview in any law enforcement situation. He also stated that it can uncover connections to other criminal activities. Feere stated that interviews with jailed aliens can help officers learn a lot about their entry and exit routes, as well as who they may have been working with. San Francisco is just one of many jurisdictions with “sanctuary” policies which forbid or limit cooperation to ICE. California has had sanctuary policies in place since years. Sanctuary policies are claimed to reduce crime by encouraging law-abiding illegal immigrants and other law-abiding immigrants to cooperate with police. HOUSE SPEAKER ACCEPTS San Francisco’s sanctuary policies prohibit the state and local law enforcement of honoring an ICE Detainer, which is a request for law enforcement officers to hold illegal immigrants, so ICE can transfer them into custody or put them in deportation proceedings. DHS confirmed last Wednesday that it had issued a Detainer on DePape. Fox News Digital was informed by a spokesperson for DHS that “[ICE] lodged an Immigration Detainer on Canadian National David DePape at San Francisco County Jail Nov. 1 following his Oct. 28th arrest.” Fox reported that the San Francisco Sheriff’s Office said that DePape would be released from jail if the detainer is honored. Moriarty stated that ICE requests are reviewed on a case by case basis by the sheriff to determine if informing ICE about Mr. DePape’s release date, if applicable, is consistent with local sanctuary city ordinances. “The sheriff will review all information, including the release date, before making a decision.” Brooke Jenkins, the San Francisco District Attorney, has taken a more direct approach. She told the San Francisco Chronicle that San Francisco is a sanctuary and that her policy was sacred. “We will not collaborate or coordinate with ICE.” To Feere and other opponents of sanctuary cities, the DePape case demonstrates the problems with such policies as well as the risks to public safety. He stated that he wished the person had been deported and arrested years ago. “That’s difficult to do when localities don’t want to work with ICE and do everything they can to stop ICE from accomplishing their mission.” Fox News’ Bill Melugin contributed this report.
