Report from Trooper Alexander Apodaca, condensed for clarity:
I, Trooper Alexander Apodaca, helped Sgt. LaFave with a traffic stop on the I25 Northbound Offramp to Comanche Road on July 25, 2022, at 12:54 AM. Sgt. LaFave stated that the vehicle was stopped because it failed to signal and maintain lanes. Along with six children over the age of 13 and under 18, we walked up to the driver’s car. I recognized the man as Mr. Jeremy Guthrie after Sgt. LaFave told him to get out of the car.
Mr. Guthrie was positioned in front of Sgt. Lafave’s patrol car. Sgt. Lafave began a conversation with Mr. Guthrie. We could smell Mr. Guthrie’s breath emitting a potent aroma of intoxicating adult beverage as he spoke. Mr. Guthrie’s speech was slurred, giving the impression that he was having trouble pronouncing it. I noticed Mr. Guthrie’s eyes were wet and bloodshot upon closer inspection.
I enquired as to Mr. Guthrie’s origin. Mr. Guthrie claimed to be traveling from home. I enquired as to Mr. Guthrie’s destination. Mr. Guthrie declared that he would pick someone up. I enquired as to Mr. Guthrie’s ultimate destination. Home, Mr. Guthrie said. I enquired as to Mr. Guthrie’s residence. According to Mr. Guthrie, he resided in the north valley. When was the last time Mr. Guthrie drank an adult beverage? I questioned him. About three hours earlier, Mr. Guthrie said. I enquired as to what Mr. Guthrie had eaten. Mr. Guthrie claimed to have consumed three” Sol” beers. I enquired about the beer sizes from Mr. Guthrie. The beers, according to Mr. Guthrie, were 12 ounces each. I questioned Mr. Guthrie about his willingness to take the Standardized Field Sobriety Tests. Mr. Guthrie concurred. Mr. Guthrie was escorted to my patrol car by me.
I enquired as to whether Mr. Guthrie had suffered any tragic brain injuries. He suggested sometimes. I questioned Mr. Guthrie about whether he had any issues turning, balancing, or walking. Probably, he said. I enquired as to whether he wore any contacts or glasses. He replied” no.” I enquired as to whether Nystagmus had taken a nap. He claimed he had no idea.
To Mr. Guthrie, the tests were explained and demonstrated. Mr. Guthrie responded that he did understand the instructions when asked if they were clear. He began at one thousand two. put his foot down at his count of 1,044, and then he started the count again. At his one thousand eleven count, he put his foot down a second time. Early termination of the test resulted in the past 12 seconds of test. I used two different tests because of the little slope, the potential for a traumatic brain injury, and the possibility of having trouble walking, turning, or balancing. Mr. Guthrie claimed to have enrolled in college. Mr. Guthrie claimed to be familiar with the alphabet and to count to 100. H to S test: Mr. Guthrie claimed he didn’t understand the test and needed an example when I initially offered it to him. I suggested that he retake the test. He uttered the letter H and paused for about 20 seconds. I don’t like that one, he said. The test was finally completed error-free by Mr. Guthrie.
At around 1:25 a.m., I determined Mr. Guthrie was at or above the limit or even slightly impaired, and I placed him under arrest for DWI of intoxicating alcohol and / or drugs. He was also handcuffed behind the back and had his hands double locked. The New Mexico Implied Consent Advisory was read by Mr. Guthrie. I requested a breath sample from Mr. Guthrie. Mr. Guthrie concurred. No further tests were requested by Mr. Guthrie. There were no unusual objects in Mr. Guthrie’s mouth when I checked for them. At 1:29 p.m., I took note of the deprivation period. Two open containers of adult beverages with the contents part missing were found, according to Sgt. Lafave.
Mr. Guthrie was taken to Albuquerque’s NMSP office. I put Mr. Guthrie in the test room once I was inside the office. It was permitted for the IR-8000 to conduct clinical testing. I asked Mr. Guthrie to blow into the device after going 20 minutes without being ready to eat or drink anything. I described the gadget as a breathalyzer test. Mr. Guthrie declared that he was unwilling to take the test. Mr. Guthrie debated whether or not to take the test. I read the warnings and gave Mr. Guthrie of the New Mexico Implied Consent Advisory advice. When I questioned Mr. Guthrie about taking the test, he took long pauses to answer my questions. The test later ran out of time. No sample was given.
According to an NCIC investigation of Mr. Guthrie’s legal history, he had previously committed a DWI, making this his second offense. On the following charges, Mr. Guthrie was booked into the MDC.
