For a good legal analysis, one can typically rely on Alan Dershowitz. He has been a lifelong registered Democrat who has long been good to Trump in his constitutional analysis. When I say fair, I mean that he simply expresses his honest opinion rather than the MSM story.

Dershowitz claims that Jack Smith’s case is WEAK — laughably weak — and that it fails the” Banana Republic Test.”
However … Dershowitz claims that if Trump were found guilty by a biased jury, the Supreme Court would overturn it in an instant.
Trump would lose the appeal in the circuit court, but he would prevail in court.

Dershowitz says that the case brought forward by Jack Smith is WEAK – laughably weak – and doesn’t pass “Banana Republic Test”.
But ….if Trump was convicted by a corrupted juror, Dershowitz said the Supreme Court would overturn it immediately.
Trump would lose the appeal to the circuit court but win at the Supreme Court.

This time, the indictment was based on alleged “efforts” to overturn 2020 elections via the events which culminated in the riots of the 6th of January at the Capitol. Special Prosecutor Jack Smith has announced four charges, including conspiracy to defraud government, conspiracy to obstruct a proceeding, obstruction and attempt to obstruct a proceeding, and conspiracy against the rights.
Alan Dershowitz, a Harvard professor and lawyer, sat down to discuss the former President’s legal prospects with Sean Hannity of Fox News. He suggested that, while he was likely to be convicted, he would have the ruling overturned by the Supreme Court.
Dershowitz began by saying, “They claim that Donald Trump believed he had lost the election. They claim that everything he has done is fraudulent. They claim that he conspired to influence the election with unnamed attorneys.”
“You can challenge elections.” It is true that the best way to contest elections is to create a slate of alternate voters… The government must prove beyond a reasonable degree of doubt that Donald Trump subjectively believed that he had lost the election, and acted in a manner contrary to this belief.”

He continued, “There is no smoking-gun.” “There is no credible witness who can testify that Donald Trump told him, “I know personally that I lost the election”. There is a lot evidence that people told Trump that he lost the elections, but you are familiar with Donald Trump and you know he will make his own decision.
