He concluded by saying, “There’s risk either way – if they take the fifth [amendment], the presiding judge will most likely assume they are guilty of some type of illegal activity.” Tapper questioned if that was the manner in which the situation could be handled according to New York State regulation, to which Honig responded affirmatively. The ruling is in the court’s hands, and the judge can decide that your testimony would not have been beneficial to you in this civil trial. Honig proposed that testifying could pose a greater danger since what the persons say could be used to incriminate them in potential legal proceedings, and might even lead to the revival of a prior criminal probe into the fraud.
