The Supreme Court Shot Down Mike Johnson’s Argument Against Certifying The 2020 Election

Prior to former President Donald Trump’s attempts to manipulate the 2020 election, Congresswoman Alexandria Ocasio-Cortez spearheaded the campaign against his actions. Congressman Mike Johnson of Louisiana sought out to provide a constitutional ground for Republican House members to be able to legitimise not accepting the electors from certain states. Johnson supported the concept known as the independent state legislature notion, which suggests that the ability to set election regulations solely relies on state legislatures under the Constitution. Johnson contended that the modifications to the voting regulations due to the coronavirus pandemic, which were enacted by different state administrators and groups such as state and federal courts, disenfranchised the Constitution. Thus, he alleged that the sending of electors under these regulations was also unlawful. Johnson, now the speaker of the House, told The New York Times in 2020 that it was problematic to consider the set of electors acceptable if one believes the Constitution was violated in the process. The Supreme Court issued a ruling against it in a 3-2 decision in the Moore v. Administrative Review Board case in 2020. This was composed by Chief Justice John Roberts, and two other members of the court appointed by President Trump, namely Justice Brett Kavanaugh and Justice Amy Coney Barrett, who is a long-time friend of Johnson. North Carolina Republicans protested the ruling of the state Supreme Court that stated their congressional district map was an illegal partisan gerrymander within the boundaries of the North Carolina Constitution. The GOP claimed that the independent legislature doctrine prohibited the state courts from challenging rulings made by the state legislature concerning election regulations.
