Jack Smith Says Trump Immunity Claims ‘Threaten To Undermine Democracy’

Smith’s team meticulously scrutinized Trump’s appeal to the U.S. District Court of Appeals in the District of Columbia, which requested the dismissal of the federal case on election tampering against him. Trump has presented two primary defenses: firstly, he believes he is shielded from criminal accusations stemming from actions committed during his presidential tenure, and secondly, he posits that Smith’s lawsuit is a violation of the constitutional protection against double jeopardy, as it rehashes issues that led to his impeachment in the House of Representatives and subsequent acquittal by the Senate. However, these defenses do not find much backing in terms of power divides, the wording of the constitution, historical context, or prior case law. The 82-page document stated that both arguments potentially jeopardize democracy. The recent submission emphasized that Trump’s allegations garner no backing from our constitutional legacy and accepting them would impair key principles of fairness and justice. In August, Smith accused Trump of plotting to undermine Joe Biden’s win in the 2020 presidential election. He allegedly concocted a plan to build fraudulent elector panels in select battleground states to reverse the voters’ decision. Trump has refuted all allegations of misconduct in the case, which is just one among many filed against him for actions during his one term in office. These are issues he has to face as he vies for a second term. According to the filing, “the Presidency is crucial in our constitutional framework,” yet it also highlights the importance of criminal accountability, especially for actions that undermine the democratic process. Earlier this month, U.S. District Court Judge Tanya Chutkan dismissed Trump’s argument to throw out a case against him. Trump appealed this decision, which led Smith to take the unconventional action of urging the U.S. Supreme Court to intervene and promptly resolve the matter. The Supreme Court opted not to step in before the appeals court could deliberate, as a result, the case is effectively on hold until the courts have sufficient time to thoroughly examine Trump’s multiple allegations. The appeals court is presently scheduled to consider the case in January.
