The defendant may face being investigated, charged, prosecuted, convicted, and punished for any offences committed while in office,” The former president’s legal team had argued that the case, set to be heard in March, ought to be thrown out because the potential leading 2024 Republican presidential candidate should be protected from repercussions due to activities done during his tenure as president. The indictment includes actions regarding elections which are in the realm of duties as President, which would normally grant immunity from civil lawsuits according to the Supreme Court. This immunity however has never been tested with regards to criminal prosecution. Jack Smith’s team has made clear that there is no basis that a previous president is incapable of being charged for alleged illegal behavior committed during their tenure. Furthermore, they emphasised that no one, no matter their previous status, is exempt from the law. This is one of the four criminal cases he’s currently having while running for US presidency in 2024.
