According to jail records, Avraham Gil, 19, was detained over the weekend on suspicion of aggravated battery and violently resisting a law enforcement officer.
According to an arrest affidavit, Gil reportedly crashed his motorcycle into the policeman who had stopped in traffic, breaking his leg in the process.
Gil’s defense lawyer asserts in bond court on Sunday that because his father is an Israeli consul in Miami named Eli Gil, Gil enjoys diplomatic immunity.
But, the teen is certainly entitled to immunity, according to a statement from the State Department in Washington.
Gil has reportedly had several run-ins with police in recent weeks, according to the local media.
Video of the teenager being stopped for a traffic stop in Miami Shores was captured by WPLG Local 10.
Gil mentions his father’s career as a diplomat in the video.

According to an arrest report, Gil rode up on his motorcycle and weaved in between vehicles as the officer approached the vehicle he pulled over. Gil continued to ride towards the lieutenant and “intentionally ran him over” despite the officer’s motions and yells for him to stop, according to the police.
Gil was grabbed by the officer, who had an “incapacitating” injury to his left leg, and was brought to the ground to stop him. Gil was detained by police on a first-degree felony charge of violently resisting an officer and aggravated battery on him.
The policeman is still unemployed.
Gil is even being pulled over by Miami Shores police, according to a Dec. 31 video.
Gil is accused of aggravated battery on a law enforcement officer and violently resisting an officer, both of which are first-degree felony offenses.
A Miami-Dade State Attorney’s Office spokesperson stated in a statement on Thursday that the defendant was released on his personal recognizance after the defense attorney was relied upon. We are continuing with our investigation as usual after receiving confirmation from the State Department, Office of Foreign Missions, that both the defendant nor his father have political immunity. The investigation into Mr. Gil is still ongoing.
The teen’s attorneys have defended his innocence.
David Seltzer, an attorney, issued a statement to Local 10 News:
” A law enforcement officer must quickly and accurately determine the status of any person identifying themselves as part of a political attachment, which Mr. Gil did many times in accordance with the procedure. Foreign diplomats are associated with several documents, making it challenging to determine a diplomat’s status without verification. Sunny Isle Police Department ( SIPD ) broke the rules and procedures in place to determine whether Mr. Gil actually had immunity in this particular case. He was said to have immunity at the original bond hearing, according to the statement.
Federal registration documents and driver’s licenses do no expressly reflect the degree of privileges and immunities of the bearer, in accordance with Department of State guidelines. They should only be used as a hint that the bearer might have some level of immunity.” Since SIPD failed to adhere to established, accepted procedures, there was no clarity on his status. Mr. Gil was merely driving and had no intention of hitting the police officer, as can be seen from the video taken just before the incident, and there is no evidence to the contrary. Avraham Gil (19) was arrested on charges of resisting a police officer with violence, and aggravated assault of a law enforcer, according to jail records.
Gil allegedly plowed into a police officer who was making a traffic stop and injured his leg, according to an arrest affidavit.
Gil’s lawyer claimed to the judge in bond court on Sunday that Gil has consular immunities because his father Eli Gil is an Israeli consul based in Miami.
The State Department in Washington, however, said in a press release that the teen does not qualify for immunity.
Gil, according to local media reports, has had multiple encounters with police officers over the past few weeks.
WPLG Local 10 filmed the teenager who was pulled over in Miami Shores for a traffic violation.
Gil mentions in the video that his father was a diplomat.

A police report states that Gil was weaving between cars as the officer approached his vehicle. Police said that the officer motioned to Gil and yelled for him to stop. But instead, Gil kept riding towards Lieutenant and “intentionally” ran him over.
The report states that the officer, who had suffered an “incapacitating injury” to his left leg grabbed Gil and threw him to the floor to stop him. Gil was arrested on a first degree felony charge for aggravated assault on a law-enforcement officer and resisting a police officer with violence.
The officer is still not working.
A video taken on December 31 shows Gil being stopped by Miami Shores Police.

In a statement released Thursday, a spokesperson from the Miami-Dade State Attorney’s Office stated that the defense counsel’s representation had been relied on and the defendant had been released on his own recognizance. “After receiving confirmation from State Department’s Office of Foreign Missions that neither the defendant nor father has diplomatic immunity, we continue with our investigation as usual. Mr. Gil is still charged and the case remains open.”
The attorneys for the teenager have maintained that he is innocent.
Attorney David Seltzer has released a statement for Local 10 News.
“It’s critical for a police officer to quickly and accurately identify the status of anyone identifying themselves as a member of a diplomatic attache, which Mr. Gil performed several times in accordance with procedure. It is difficult to verify a diplomat’s identity without verifying the documents that are attached. Sunny Isle Police Department (SIPD) failed to follow the protocols and procedures to determine if Mr. Gil had immunity. The statement stated that at the initial bond hearing it was reported he had immunity.
According to Department of State guidelines “…federal identification documents and driver’s licences do not reflect the level of privileges and immunity of the bearer. They should only be used as a guide to determine whether the bearer has some immunity …”. As can be seen in the video, Mr. Gil did not intend to hit the officer and there is no evidence that he did. “We are confident that Mr. Gil will not be found guilty when all the facts are revealed,” it said.
