During Thursday’s hearings, the justices are set to grapple for the first time with a post-Civil War constitutional measure designed to bar past officials who participated in an “insurrection” from regaining office. The case represents the court’s most significant engagement with a presidential election since Bush v. Gore. A verdict reached 25 years earlier essentially handed the 2000 election to the Republican candidate George W. Bush. The case arrives before a judiciary that has faced censure concerning ethical matters, prompting the judges to establish an initial set of ethical guidelines in November. This is occurring during a period when the public’s opinion of the court is notably low, reaching almost historically minimal levels in polls. This issue arises from the attempt by Republican and independent voters in Colorado to remove Trump from the state’s Republican primary ticket due to his actions to dispute his 2022 electoral defeat to the Democrat Joe Biden, which reached a climax with the events of January 6. In 2022, following the violent events at the United States Capitol, the Supreme Court of Colorado ruled that former President Trump provoked the disturbance in Washington D.C. Consequently, he is disqualified from pursuing the presidency in the future and should not be listed as a candidate in the upcoming March 5 primary in Colorado. Should the Colorado electorate emerge successful, it would signify an acknowledgment by the court’s judges, among whom three were nominated by Trump during his tenure, that he participated in a rebellion and is hence prohibited by the 14th Amendment from serving in office once more. This could enable states to exclude him from the voting ballot, thereby jeopardizing his electoral campaign. A final decision favoring Trump would effectively put an end to attempts in Colorado, Maine, and other states to block him from being listed on the voting ballot. While the justices might choose a more indefinite resolution, they are aware that the matter could resurface, potentially after the November general election, potentially amidst a severe constitutional crisis. The Supreme Court has indicated its intention to expedite the process by significantly reducing the time for submitting written briefs and conducting courtroom arguments. Concurrently, Trump is challenging in a state court the decision made by Maine’s Democratic Secretary of State, Shenna Bellows, that declared him unfit to be on Maine’s ballot due to his involvement in the Capitol riot.
