Judge Dismisses Case For Fake COVID-19 Vaccine Passports, Criticizes DA For Not Prosecuting Violent Criminals

State Supreme Court Justice Brendan T. Lantry dismissed the pair’s unnamed felony charges this week, referring to the case as excessive.
Hundreds of people were accused of purchasing false vaccination cards from New Jersey prostitute Jasmine Clifford, including J. O., a nursing student, and R. V. of working for the city’s Department of Environmental Protection.
According to the judge, the two were among simply 16 individuals Bragg’s office” cherry-selected” to prosecute and charge with felony unlawful possession of a forged instrument.
Fourteen entered a misdemeanor criminal plea, but J. O. and R. V. moved to drop the charges, prompting the DA’s office to challenge the case and infuriating the judge.
In an opinion released on Tuesday, the judge stated that Bragg’s office “routinely — nearly daily- move]s ] to dismiss significantly more serious counts or entire indictments” in order to avoid harsher penalties for previously convicted felons or to prevent endangering individuals ‘ immigration status.
” These motions submitted [ by Bragg and his prosecutors ] are made months or even years after the 45-day period has passed to dismiss… sexual assaults, drug sales, robberies, burglaries, and other violent and non-violent serious felony offenses.”

The factual accusations against Defendants R. V. and J. O. are not particularly serious in nature, and Criminal Possession of a Forged Instrument in the Second Degree ( Penal Law 170.25 ) is not one of the most serious crimes in New York. Additionally, the factual claims that the defendants bought fake COVID-19 vaccination cards so they could give them to their employer ( R. V. ) and school ( J. O. ) —do never rise to the level of the majority of crimes decided in New York County’s Supreme Court, including homicide, sexual assault, drug sales, robbery, burglary and other harsh and non-violent significant felony offenses, the decision read.
In order to avoid the effects of New York’s predicate felon sentencing statutes or to prevent immigration consequences, the People routinely—nearly daily—move to dismiss considerably more serious counts or complete indictments.

The judge went on to say that Bragg and his office “move to dismiss considerably more severe counts or complete indictments” and avoid harsher penalties for much more violent and convicted felons almost every day. Additionally, after allegedly beating up two NYPD officers, Bragg late permitted a group of all illegal immigrants—aside from one—to be released without bail. Eventually, he defended this by claiming that the digital evidence was insufficient to keep the foreigners in custody.
Government officials in New York City, including Bragg, have come under increasing scrutiny for both the government’s feeble efforts to reduce crime in the city and the significant influx of undocumented immigrants.

In a ruling released this week, State Supreme Court Justice Brendan T. Lantry dismissed the felony charges against a pair of unidentified individuals, calling the case excessive.
J.O. a nursing student and R.V. an employee of the city Department of Environmental Protection were among hundreds of people accused of buying fake vaccination certificates from a New Jersey Stripper, Jasmine Clifford.
The judge said that the two were “cherry-picked”, as only 16 people had been selected by Bragg’s Office to be prosecuted and charged with felony criminal possess of a forgery.

The judge explained that Bragg’s office and Bragg “move almost daily to dismiss significantly more severe counts or entire Indictments” in order to avoid harsher punishments for violent felons and convicted felons. Bragg recently released all but one illegal immigrant without bail, after they allegedly beaten up two NYPD police officers. He later defended his actions, saying that video evidence alone was not enough to keep the foreign nationals in custody.
NYC government officials including Bragg have been under increasing scrutiny for their ineffective efforts to control crime and the high number of illegal immigrants.
