CANADA: Judge Rules Woman With Autism Can Seek Medically-Assisted Suicide

Justice Colin Feasby ruled that the woman’s injunction barring the woman from ending her life had been lifted.
The woman’s father recently asked a judge to block her doctor- assisted suicide.
According to the Calgary Herald,” Feasby said his decision will be postponed for 30 days so that the father’s attorney, who is just known as MV, can decide whether to file an appeal.”

The judge of the Calgary Court of King’s Bench said he had to weigh the possible harm an injunction might cause on top of the harm her parents might suffer if the injunction was lifted. The 27-year-old woman, who has autism, had to weigh the risks.
In his published decision, Feasby wrote,” The harm to MV is done if an injunction is given goes to the core of her being.”
” An injunction would not grant MV the right to choose between living or dying with dignity.” A decision to end MV’s life without health assistance would also result in an injunction that would force her to make the decision.
Attempting to end MV’s life without medical assistance would increase her risk of pain, suffering, and permanent injury, according to the statement,” This is a terrible choice that should n’t be forced on her.”
A 27-year-old American woman with autism discovered two doctors who were prepared to pay her for her euthanasia.
Her parents have filed a lawsuit to stop it.

The judge expressed sympathy for MV’s parents ‘ desire to keep their daughter alive.
However, Mark Holland (L-Ajax ), the health minister for Trudeau, made it clear on Monday that the country’s need for mental health will unavoidably justify the death penalty.
” Is your intention to also move ahead with MAiD for mental illness, just within a longer timeframe? ” a reporter asked.
” That’s appropriate,” Holland replied at a news conference.
There are people who have been subjected to psychological torture for decades, who have tried everything, exhausted all options, and who are now claiming to want access to MAID, he continued.

According to Feasby’s summary of her father’s position, he believes MV” is resilient and is certainly capable to make the decision to take her own life.”
” He says that she is usually good and believes that her physical symptoms, to the extent that she has any, result from untreated mental conditions,” CBC reports.
The outlet claimed autism and ADHD are the only known diagnoses MV’s just known diagnoses as of earlier this month were.

W. V.’s attorney requested that the time injunction continue on March 11th when M. V.’s attorneys requested that a judicial review be conducted to determine how the daughter obtained MAID approval.
Now, two doctors or nurse practitioners have to approve a patient for MAID.
According to Feasby, M. V. first approached two doctors. One agreed to approve her for MAID, the various denied the application.
A second” tie- breaker “doctor, as described by lawyers for Alberta Health Services, was subsequently offered to M. V.
Her father took issue with the second doctor who signed off on M. V.’s MAID approval” because he was no impartial or achievement.”
At the March 11 hearing, Sarah Miller, counsel for the father, called the situation” a fascinating issue for Alberta “because the province operates a system where there is no appeal process and no means of reviewing a person’s MAID approval.”}]] [[{“value”:”

The Calgary Court of King’s Bench Judge said he must weigh the harm that an injunction could cause to the 27-year old woman with autism against the harm that her parents would suffer should the injunction be lifted.
Feasby wrote in his ruling that “the harm to MV if a preliminary injunction is granted, goes to the core” of her being.
“An injunction will deny MV her right to choose whether she wants to live or die with dignity. In addition, an injunction could force MV to choose between a life that she finds intolerable or ending her life without medical help.
“This is a terrible decision that should not have been forced on MV. Attempting to end her life with no medical assistance would increase her risk of suffering, pain and permanent injury.”

Two doctors in Canada were willing to support the euthanasia of a 27-year-old woman with autism.
Her parents have taken her to court in an attempt to stop it.
Imagine the pain her parents must be feeling.

The judge said he understood the parents’ desire to keep MV alive.
Trudeau’s Health Minister Mark Holland, (L-Ajax), announced on Monday that mental illness will be a justification to grant euthanasia at Canada.
A reporter asked: “Do you still intend to move forward with MAiD, but within a longer timeline?”
Holland responded at a press conference, “That’s right.”
“There are people, who have been trapped in mental torment for decades. They have tried everything, exhausted all avenues, and are now saying, under their own recognition, that they want MAID,” he added.

According to Feasby, who summarized her father’s view, MV is “vulnerable and not competent to decide to take her life.”
CBC reports that “He says she is generally healthy, and believes that any physical symptoms she may have are due to undiagnosed mental conditions.”
The outlet stated that MV’s only diagnoses, as described in court earlier this year, were autism and ADHD.

W.V.’s lawyer asked that the interim injunction be continued and a judicial inquiry ordered to examine how the daughter received MAID approval.
Currently, MAID requires two doctors or nurse practitioners to approve the patient.
M.V. initially approached two doctors, Feasby was told. One doctor agreed to sign-off on her approval for MAID and the other denied it.
M.V. was then offered a third “tiebreaker” doctor as described by Alberta Health Services lawyers.
Her father criticized the third doctor for not being independent or objective when he signed off on M.V.’s MAID approval.
Sarah Miller, the counsel for the father at the March 11 hearing called the situation a “novel issue for Alberta”, because the province has a system that does not allow for an appeal process or a review of a person’s approval for MAID.
