Mexico Says It Will Not Accept Migrants From Texas ‘Under Any Circumstances’

The Ministry of Foreign Affairs, in a press release, condemns the passage of Texas law SB4, which seeks to end the flow of migrants by criminalizing them, encouraging family division, discrimination, and racial profiling, and a violation of the immigrant community’s individual rights, on behalf of the Mexican government.
Any measure that permits state or regional authorities to impose immigration controls, detain and bring people or foreigners to Mexican territory is absolutely rejected, according to Mexico.
Mexico acknowledges the value of a universal immigration policy and the diplomatic efforts being made to ensure that migration is safe, peaceful, and human rights are respected, and is unaffected by local or state legislative decisions. In this regard, Mexico will never accept, under any circumstances, repatriations by the State of Texas”, it added.

Additionally, Mexico intends to submit a friend-of-the-court brief to the Fifth Circuit Court of Appeals in New Orleans to provide information on how SB 4 will affect Hispanic and Mexican-American communities, as well as how it will affect Mexican-U.S. relations.
The law has been strongly criticized by opponents of SB 4, which allows Texas authorities to arrest illegal immigrants who could face deportation or jail time. The great court said the statute can be enforced while it is pending in a federal appeals court in a 6- 3 decision on Tuesday.
While the SCOTUS ruling was praised by Republicans, Democrats mostly went in the opposite direction.

Under the Texas law, after defendants are in custody on unlawful entry charges, they can agree to a judge’s order to leave the U. S. or face prosecution. Mexico’s Foreign Affairs Secretary declared in a sharp statement on Tuesday that it would not accept anyone who was ordered to cross the border.
Mexico “reaffirms its reputable right to defend the rights of its citizens in the United States and to establish its own immigration policies,” the government said.
The impact goes way beyond the Texas border. Although Steve McCraw, the director of the Texas Department of Public Safety, has stated he expects it to mostly be enforced near the border, Democrat legislators wrote the law but that it applies to all of the state’s 254 counties.
Another GOP-led states are now considering a course change for Texas. A bill that would even give its state law enforcement the authority to arrest people who are in the country illegally and have previously been denied entry to the country was last approved by the state House in Iowa on Tuesday.

In a statement, the Mexican Foreign Ministry condemned this legislation.
The press release stated that “On behalf of Mexico’s Government, the Ministry of Foreign Affairs condemned the entry into effect of Texas law SB4, SB4 seeks to stop migration by criminalizing migrants and encouraging separation of families and discrimination, racial profile and racial profiling, which violates the human rights of migrant communities.”
Mexico categorically rejects measures that allow state or local authorities the authority to exercise immigration control and to arrest and bring back nationals or foreigners into Mexican territory,” it added.

Mexico will also file a friend of the court brief with the Fifth Circuit Court of Appeals, New Orleans, to provide information about the impact of SB 4 on Mexican and Mexican American communities, as well as the impact on Mexican-U.S. relationships.
SB 4 opponents have criticized the law, which allows Texas authorities arrest illegal immigrants and potentially deport them or sentence them to jail. The high court ruled on Tuesday that the statute could be enforced as long as it is pending before a federal appeals courts.
Republicans praised the SCOTUS decision, but Democrats largely took the opposite position.

According to Texas law, defendants who are in custody for illegal entry can either agree to a court order to leave the U.S., or face prosecution. In a strongly worded statement, Mexico’s Secretary of Foreign Affairs said on Tuesday that the country would refuse to accept anyone who was ordered to cross border.
The government stated that Mexico has the right to protect its citizens in the United States, and to determine its own policy regarding entry into its territory.
The impact of the law extends beyond the Texas border. The law was written by Republican legislators to apply in all 254 counties of Texas, but Steve McCraw, director of the Texas Department of Public Safety has said that he expects the law to be enforced mainly near the border.
Other GOP-led state are already looking at Texas’ example. In Iowa, on Tuesday the state House approved a bill which would give the state’s law enforcement the authority to arrest people in the U.S. who are illegally present and who have been refused entry to the country previously.

Steven Holt, a Republican state representative from Iowa, said: “The federal government abdicated its responsibility and the states can and must take action.”
El Paso County Judge Ricardo Samaniego in Texas, the top county executive said immigration enforcement should be a federal responsibility, not a state’s, echoing Biden administration views. He said that during a previous surge of migrants, the increased presence of law enforcement in El Paso led to high-speed chases in the city and traffic stops on the assumption that passengers were illegally in the country.
