Pornhub has decided to shut down its website in Texas due to their disagreement with a new law that mandates age verification for users. A message now appears for Texas users stating that state officials are requiring age verification to access the website. This not only violates the rights of adults to access protected speech, but it also does not pass strict scrutiny because it uses the least efficient and most restrictive methods to achieve Texas’s goal of protecting minors. Although safety and compliance are our top priorities, constantly requiring identification when accessing an adult platform is not an effective way to safeguard users online. This practice can actually jeopardize the privacy of both minors and adults. The statement explains that mandating age verification like this pushes individuals to other sites that have less safety protocols. It further states that the Texas law regarding age verification is ineffective, inconsistent, and risky. Not only will it fail to protect children, but it will also limit content creators’ ability to share legal adult content and affect their capacity to convey artistic messages. Texas Attorney General Ken Paxton filed a lawsuit against Aylo, the parent company of Pornhub, last month in order to ensure compliance with a law that was enacted the previous year. Paxton argued in a statement when submitting the lawsuit that Texas has the right to shield its children from the harmful impacts of explicit material.
