The Department of Homeland Security confirmed to Sen. Lindsey Graham, R-SC, that the alleged killer of Georgia student Laken R. Riley was paroled illegally into the country.
According to the U.S. Senate Judiciary Committee Jose Antonio Ibarra received “parole because of the detention capacity at Central Processing Center in El Paso Texas.”

Ibarra was a Venezuelan citizen who was paroled to the United States in September of 2022. He was arrested in February of 2024 for Riley’s murder. Graham, after Riley’s murder, wrote to DHS Secretary Alejandro Mayorkas and asked for the reasons why Ibarra had been paroled into the United States.
According to law, immigration parole can only be granted by the DHS Secretary at his discretion, on a case-bycase basis, when there is an “urgent humanitarian need or significant public benefit.”
The Biden administration is breaking the law on innocent Americans’ behalf.
On Thursday, Republican lawmakers criticized DHS Secretary Alejandro Mayorkas for the release of Ibarra.
“Mayorkas caught in a falsehood. He said that 8 days ago, Laken Riley’s murderer was released because the feds had no good reason to keep him in custody. Lawmakers grilled the embattled Secretary on Jose Ibarra. He is an illegal immigrant who came from Venezuela and is accused of killing Riley in February, while she was running at the University of Georgia, Athens.
Immigration and Customs Enforcement confirmed to Fox News Digital that U.S. Customs and Border Protection had encountered Ibarra in September 8, 2022 and he was “paroled and freed for further processing.”
Conservatives, however, have pointed out that ICE’s capacity was not at its maximum when Ibarra was released. The statute governing the parole system states that only urgent humanitarian reasons and “significant public benefits” can be used to release a prisoner. However, some conservatives have pointed out that ICE was not at maximum capacity when Ibarra was released.
Ranking Member Rand Paul questioned Mayorkas on Ibarra’s parole and the legality of its basis. Mayorkas refused to comment on the case.
“All of our hearts are broken for the Riley family. Second, the perpetrators of this heinous crime must be brought to justice to the fullest extent possible. “I will not comment on specifics of the case because the matter is currently being prosecuted,” he said.
Mayorkas replied, “I have given my answer”, but later elaborated.
There are different grounds for parole. “I am not a lawyer, but I can assure you that if an individual is found at the border and deemed to be a threat to national security or public safety at the time, they will be detained as a matter of priority,” he said. “If they do not, then they will receive a notice of appearance and be placed in immigration enforcement procedures. The number of people we encounter at the border is greater than the number of beds in our detention centers. This is not a problem that is unique to the current administration.”
