Judge In Trump’s Classified Documents Case Grants A Prosecution Request

However, U.S. District Judge Aileen Cannon rejected the idea of completely blocking witness statements from being revealed, stating that such a broad restriction was unjustified. The 24-page document focuses on a disagreement between special counsel Jack Smith’s team and attorneys representing Trump regarding the level of disclosure of information about witnesses and their statements before the trial. The dispute, unresolved for weeks, was just one of several that had accumulated before Cannon and had caused delays in the case against Trump – one of four legal battles he is currently facing. A definite trial date has yet to be set for the case, although both parties have indicated they may be prepared by the summer. Cannon, who had previously been strongly criticized for agreeing to Trump’s request for an outside evaluator to examine documents from an FBI search of Mar-a-Lago, expressed ongoing doubt about the government’s prosecution theory. She stated on Tuesday that the case presented unclear and evolving issues. By changing his previous decision and agreeing with prosecutors to keep witness identities confidential, Cannon probably prevented a significant escalation of tensions with Smith’s team. Last week, Smith’s team criticized another order issued by the judge as being deeply flawed. The problem arose in January when defense attorneys submitted a motion, in a partially redacted form, demanding that prosecutors hand over a large number of documents. The defense claimed that these documents would support their argument that the Biden administration had tried to use the government to unfairly charge Trump. The defense attorneys requested approval to submit the motion, which contained attachments of information obtained from the prosecutors with minimal redaction.
