Judge Reportedly Said Second Amendment Doesn’t Exist In Courtroom, Man Faces 18 Years In Prison For Gunsmithing

Dexter Taylor, a tribal of New York, was found guilty of 13 weapons-related felony counts after being detained and charged with gunsmithing in 2022.
” He liked the nature of putting up guns from lawfully purchased parts”, Bearing Arms stated.
But, Taylor was forced to leave New York because of his gunsmithing passion.
Jeff Charles provided more information about the RedState incident:
Taylor was found guilty of second-degree unlawful possession of a packed weapon, four counts of third-degree unlawful possession of a weapon, five counts of unlawful possession of five or more firearms, unlawful possession of five or more pistols, violation of a registration certificate, and prohibition on empty frames or receivers. The lesser charges, such as third-degree unlawful possession of three or more firearms and third-degree weapon possession, were certainly cast in the vote.
Taylor, a 52- year- old New York native and a software engineer, discovered the world of gunsmithing years before. He made the decision to pursue it as a hobby and probably launch a business in the future. Nevertheless, when a joint ATF/NYPD task force discovered that he was purchasing parts legitimately from diverse businesses, they launched an investigation that led to an arrest and SWAT operation.
He is now awaiting sentencing in Rikers Island while he is being held in jail. Taylor’s conviction highlights the continued battle for gun rights. During an interview with Vinoo Varghese, Taylor’s defense lawyer, he detailed how Taylor’s trial proceeded and highlighted a different bias in favor of the prosecution.
Varghese described how Taylor’s interest in weapon science during the COVID- 19 lockdowns led him to pursue his gunsmithing hobby. ” He ended up building, I believe it was eight pistols and five rifles or six rifles, AR- style rifles, and next eight or nine Glock pistols that he built”, Varghese said.
According to Varghese, the judge presiding over the case said the Second Amendment does n’t exist in their courtroom.
” She told us,’ Do not bring the Second Amendment into this courtroom. It does n’t exist here. So you ca n’t argue Second Amendment. This is New York,'” Varghese told RedState.

This just sounds like” the Aloha spirit” nonsense, where some parties appear to believe that the Constitution does n’t actually apply because they really, really do n’t like it.
Is the judge in this case, Judge Abena Darkeh, suggesting that the Second Amendment does n’t apply anywhere she does n’t approve? What other rights do n’t exist in New York under Judge Darkeh’s paradigm? Do defendants never have the right to representation? Is completely speech no- existent?
Oh, one might make the case that I’m being ridiculous, but I do n’t think I am. Never based on Darkeh’s different actions.
Varghese even attempts to use a jury nullification strategy. In essence, you convince the jury that despite the possibility that a crime might have occurred, the law in question is the true issue. It’s unique, but it’s also a thing. Judges are n’t supposed to encourage it, but they’re not supposed to stop it.
Yet Judge Darkeh actually carried out that. Apparently, she reportedly warned jurors in a way that made it seem as though they could face consequences if they did n’t vote to convict.

According to Varghese, Taylor is scheduled to be sentenced on May 13, and it appears Judge Darkeh will probably use him as an example to send a message to others who might consider acquiring their personal firearms in New York. He could be facing between 10 and 18 years in prison”, Charles wrote at RedState.
But, Taylor and Varghese are determined to fight as long as possible.
In national court, Varghese believes they have a chance to prevail.

A case in New York should have made headlines across the United States, but it hasn’t received much media attention.
Dexter Taylor is a New Yorker who was convicted in 2022 of 13 weapons offenses after being arrested and charged for gunsmithing.
Bearing Arms said that “he liked the idea of assembling guns from parts purchased legally.”
Taylor’s gunsmithing hobby was a target for the tyrannical New York state.
Jeff Charles gave details about the case on RedState
The jury found Taylor guilty on charges of second-degree crime possession of a loaded firearm, four counts of third degree crime possession of weapon, five counts criminal possession a firearm, illegal possession of pistol ammunition and violation of certificate registration. They also prohibited unfinished frames or receivers. Two lesser charges were not voted upon, including third degree criminal possession of three firearms or more and third degree possession of a gun.
Taylor, a 52 year old New Yorker and software engineer, was introduced to the world of gunsmithing many years ago. He initially thought of it as a hobby that he could turn into a business in the future. When a joint ATF/NYPD Task Force discovered that he was buying parts legally from different companies, they launched an investigation which led to a SWAT operation and arrest.
He is currently in jail on Rikers Island while he waits for his sentencing. Taylor’s conviction highlights ongoing gun rights battle. Vinoo Varghese was Taylor’s lawyer and he described how Taylor’s case proceeded. He also highlighted a bias on the prosecution’s side.
Varghese explained how Taylor was inspired to start his hobby of gunsmithing after he became fascinated with weapon science during the COVID-19 Lockdowns. Varghese stated that Taylor built eight Glock pistols, five AR-style rifles (or six rifles), and eight or nine pistols.
Varghese claims that the judge who presided over the case told him that the Second Amendment didn’t exist in the courtroom.
“She told us: ‘Do NOT bring the Second Amendment in this courtroom. It doesn’t exist in this courtroom. You can’t argue the Second Amendment. Varghese told RedState, “This is New York.”

This is a bit like the “Aloha spirit” nonsense, where some parties think that the Constitution does not apply because they don’t really like it.
Does Judge Abena darkeh suggest that the Second Amendment does not apply to places she doesn’t like? Judge Darkeh’s paradigm does not allow for any other rights in New York. Do defendants have the right to be represented? Does free speech not exist?
You could say that I am being ridiculous, but I do not believe I am. Not based on Darkeh’s other actions.
Varghese tries to use a jury nullification strategy. The jury nullification process is a way to convince the jury that, while a crime may have been committed, the law at issue is the real problem. It’s not common, but it does happen. Judges shouldn’t encourage it, but neither should they stop it.
Judge Darkeh, however, did exactly that. She reportedly warned the jurors that they would face consequences if their vote was not for conviction.

Varghese says that Taylor is due to be sentenced by the judge on May 13 and it seems Judge Darkeh may make an example of him in order to send a clear message to other people who might be considering building their own guns in New York. Charles wrote on RedState that Taylor could face between 10 and 18-years in prison.
Taylor and Varghese, however, are determined to fight for as long as they can.
Varghese thinks they have a good chance of winning at federal court.
