Pfizer And BioNTech Face Lawsuit Over mRNA Technology, Accused Of Infringing Patents Filed About One Decade Before COVID-19

[[{“value”:”GSK, a company owned by GlaxoSmithKline, has filed a lawsuit against Pfizer and BioNTech, alleging that the COVID-19 jab manufacturers violated patents relating to mRNA technology in the experimental shots.
The lawsuit stated that” GSK Biologicals is the sole owner and assignee of numerous United States patents relating to formulations containing lipids and messenger ribonucleic acid ( ‘mRNA’ ) molecules encoding an immunogen and methods for administering the same,” and that” GSK Biologicals is the sole owner and assignee of those patents.”
Andrew Geall, an accomplished formulation scientist and the named inventor of the Patents- in-suit, joined a team of talented researchers working under the direction of vaccinologist Christian Mandl ( the” Mandl team” ) in 2008, more than a decade before the SARS- CoV- 2 ( 2019 ) coronavirus disease pandemic. These people discovered formulations made up of lipids and mRNA molecules encoding a popular immunogen that offer protection from popular infection. The Mandl team described the inventions then claimed in the Patents- in- Suit, in patent applications filed in 2010″, it continued.

In a statement, a Pfizer spokesman said the company is” comfortable in our IP position around Comirnaty” and plans to “vigorously defend” against GSK’s claims. A representative for BioNTech declined to comment on the complaint.
A GSK spokesman said the company believes its patents “provided the fundamental technology for the COVID- 19 mRNA vaccines” and that it is “willing to license these patents on economically reasonable terms and ensure continued calm access.”
The lawsuit is just one more high-profile U.S. court case involving Pfizer, BioNTech, and Moderna over patent remuneration for their vaccines, including one brought by Moderna against Pfizer in 2022.
Pfizer made$ 11.2 billion from sales of Comirnaty next year, while Moderna earned$ 6.7 billion in revenue from its vaccine Spikevax. In comparison to 2022, sales of both vaccines drastically decreased next year.

Two GSK units—GlaxoSmithKline Biologicals SA and GlaxoSmithKline LLC —allege several versions of Pfizer Inc. and BioNTech SE’s Covid- 19 vaccine, Comirnaty, infringe US Patent Nos. 11, 638, 693, 11, 638, 694, 11, 666, 534, 11, 766, 401, and 11, 786, 467, according to a complaint filed Thursday in the US District Court for the District of Delaware.
According to the complaint, Pfizer and BioNTech “have reaped billions of dollars in revenue from infringing GSK’s patents- in- suit and continue to profit, without actually obtaining a license.” GSK requests a fair royalty for infringement and a per-contractual licensing fee.
The patents cover formulations that include lipids, or fats, and mRNA molecules that encode an immunogen, a substance that triggers an immune response. The technology is used to develop vaccines that instruct cells to produce a protein that will trigger an immune response and have applications to a wide range of illnesses.
A team of researchers discovered the copyrighted formulations, which presented a major challenge in the field of mRNA molecules and their effective delivery to human cells, according to the complaint.
The researchers, according to the complaint, were employed by Novartis AG subsidiaries when they began developing mRNA vaccines in 2008. In 2015, GSK Biologicals transferred a significant portion of Novartis ‘ global vaccines business, including the rights that would be granted to the asserted patents.

In a statement, a Pfizer spokesperson stated that the company was “confident” in its IP position regarding Comirnaty and intended to “vigorously” defend itself against GSK’s allegations. A BioNTech representative declined to comment on this complaint.
A GSK spokesperson stated that the company believes that its patents “provided foundational technology” used in Pfizer’s and BioNTech’s COVID-19mRNA vaccines. It is “willing” to license the patents at commercially reasonable terms to “ensure continued patient access.”
The lawsuit is part of a series of high-stakes U.S. courts cases involving Pfizer and BioNTech over patent royalties on technology used in vaccines. Moderna will also be suing Pfizer by 2022.
Pfizer earned $11.2 billion last year from the sale of Comirnaty, while Moderna made $6.7 billion from the vaccine Spikevax. Both vaccines saw a significant drop in sales last year compared to 2022.

A complaint filed on Thursday at the US District Court for the District of Delaware cites patent numbers 11,638,693, 11,638,694, 11,666,534 and 11,766,401 as infringing.
Pfizer, BioNTech and others “have earned billions of dollars from infringements of GSK’s patents and continue to do so without ever obtaining any license”, according to the complaint. GSK is seeking a reasonable royalty and a mandatory ongoing licensing fee for infringement.
Patents are issued for formulations that contain lipids or fats and mRNA molecules which encode an immunogen. An immunogen is a substance that triggers a response from the immune system. The technology is used to make vaccines that tell cells to produce a specific protein that can stimulate an immune reaction. It can be used against a wide range of diseases.
According to the complaint, a team discovered the patented formulations by finding a way to protect the mRNA molecules, and deliver them to human cells in an effective manner. This was a significant problem in the field.
The complaint states that the researchers were working at Novartis AG subsidiary when they began developing mRNA vaccines. The inventions, including the rights to the asserted claims, were transferred to GSK when GSK Biologicals purchased a significant portion of Novartis’ global vaccines business in 2015.
