Texas appeals court says winter storm lawsuits against transmission and distribution utilities can move forward

 A three-judge appeals panel in Texas on Wednesday ruled that transmission and distribution utility ( TDU) lawsuits involving winter storms can proceed. The 14th Court of Appeals in Houston, Texas, has approved the decision, which will allow lawsuits against CenterPoint Energy and Oncor Electric to proceed based on negligence claims. A three-judge appeals panel in Texas on Wednesday ruled that transmission and distribution utilities ( TDUs ) lawsuits against winter storms can proceed. The 14th Court of Appeals in Houston, Texas, has issued the ruling that will allow lawsuits involving the fatal 2021 winter storm to proceed on grounds of negligence against defendants CenterPoint Energy and Oncor Electric.
