This is intolerable. Our nation suffered a long-lasting harm as a result of WHO’s failure during the COVID-19 pandemic, which was both catastrophic and foreseeable. Before even considering changes to the International Health Regulations ( IHR ) or any new pandemic-related treaty that would increase WHO authority, the United States can afford to ignore this most fundamental WHO failure. We ask you to change your mind and are seriously concerned that your administration continues to support these initiatives. We contend that IHR amendments may not be taken into account at the WHA next month because the WHO has also never sent the final amendments text to member states. Instead of addressing the WHO’s well-documented shortcomings, the treaty focuses on mandated resource and technology transfers, shredding intellectual property rights, infringing complimentary speech, and supercharging the WHO. We are still unaware of COVID-19’s origins because Beijing continues to obstruct a genuine separate investigation, so moving forward with a new pandemic preparedness and response treaty ignores this. We strongly urge you not to join any pandemic relevant treaty, law, or agreement being considered at the Seventy-seventh WHA. We declare in the most compelling terms that we think any such agreement is a treaty requiring the consent of two-thirds of the Senate under Article II Section 2 of the Constitution. This is unacceptable. The WHO’s failure to respond to the COVID-19 pandemic, which was both total and predictable, caused lasting damage to our country. The United States can’t afford to ignore the latest WHO failure to perform its most fundamental function. Article 55 of IHR states that any IHR amendment must be communicated to the member states four months prior to the WHA where they will be considered. We submit that IHR Amendments may not be discussed at the WHA next month as the WHO has not yet provided member states with final amendments texts. Some of the more than 300 amendments proposed by member states would significantly increase the WHO’s powers in health emergencies and constitute intolerable violations of U.S. sovereignty. It was therefore essential that the WHO adhere to the four-month notification period in order to give member states the time they needed to ensure that such proposals did not appear in the final amendment package to be considered by the WHA. Amendments are not allowed because the WHO failed to comply with this requirement. The WHO’s latest publicly available draft of its pandemic response agreement is dead in the water. Instead of addressing WHO’s well documented shortcomings, the treaty focuses instead on mandated technology and resource transfers, destroying intellectual property rights, encroaching upon free speech, and supercharging WHO. We cannot move forward with a new treaty on pandemic preparedness, response and prevention because Beijing continues to block an independent investigation. We urge you to not join any pandemic-related treaty, covenant or agreement that is being considered at the Seventy Seventh WHA. We urge you to ignore this advice and declare that any such agreement is a treaty which requires the approval of two-thirds the Senate in accordance with Article II Section 2 the Constitution. We urge you to withdraw your support for the current IHR Amendments and pandemic Treaty Negotiations. We also urge you to shift your focus to comprehensive WHO Reforms that address the WHO’s persistent failures while not expanding its authority. And if you ignore our calls, you should submit any pandemic-related agreement to the Senate to receive its advice and consent.
