Fix To Allow Joe Biden Onto Ohio Ballot Won’t Happen Through State Legislature

According to Jack Posobiec, the Ohio Secretary of State has just warned the Democrats that they will be removed from the November ballot if they do not confirm in writing. He has given them a date by, I believe, August 5th, to determine whether or no Joe Biden will be the nominee.
He continued,” We have an issue with our law that you are holding your convention so late in the year that you are not confirming who your nominee is going to be and that you are not going to be on the ballot,” adding that he was correct.

According to the Ohio Secretary of State, Joe Biden will never be cast in November. The statement comes amid calls for Ohio’s legislatures to change a state law that mandates tight deadlines for appointing political candidates for the November ballot. Each social party has until August 7 to formally declare their presidential candidates for inclusion on the state’s November ballot for public election purposes. However, the Democratic National Convention is not until August 19; it is the party’s administrative meeting where they actually decide a nominee. That would mean, in order for Biden to appear on Ohio’s ballot, lawmakers would have to amend the law to allow Biden, who is the presumed Democrat nominee, to be on the ballot.
” It’s a hyper political environment at this time of year”, Stephens told reporters on Tuesday, according to the Statehouse News Bureau. Some Republicans simply did not want to vote on it, while others did, according to the statement.
Due to the Democratic National Convention’s date, Ohio is not the only state with a similar rule; Alabama and Washington likewise have similar laws that prohibit Biden from appearing on the state’s November ballot. Earlier this month, however, Alabama lawmakers passed specific legislation to allow the president to appear on the state’s ballot, independently of deadlines. Washington lawmakers will even allow Biden to appear on the state’s ballot through a temporary certification, so long as the Democratic Party sends temporary certification of nomination before the state’s Aug. 20 deadline, according to ABC News.

Due to the Republican-controlled state legislature, Ohio House Speaker Jason Stephens stated Joe Biden wo n’t be eligible for the state’s ballot.
” There’s simply not the will to do that from the legislature”, Stephens said.
Although it wo n’t take place through the state legislature, there appears to be another way for Democrats to ensure that Biden appears on the Ohio ballot.
Unless the Democrat Party offers a constitutionally appropriate remedy, Joe Biden will not be on the ballot in November, according to Ohio’s Secretary of State.

National Democrats will have to find an alternate route in light of the development to ensure that Biden’s name appears on November’s ballot. The Democratic National Committee might pursue an operational remedy, which some observers have referred to as a “mini-convention” that might circumvent state law, or it might file a lawsuit to seek court intervention.
Major Republicans, including Gov. Given the recent majority decision by the U.S. Supreme Court that reinstated former president Donald Trump’s right to vote in Democratic-controlled Colorado and Maine, overturning decisions by officials in those states, Mike DeWine and Republican Senate President Matt Huffman have said they believe the Biden campaign has a good chance of making the ballot.
Stephens stated that he also believes Biden will cast a ballot in some way or another. House Minority Leader Allison Russo, the leading- ranking Democrat in the Ohio House, said Tuesday she agrees.
” I’ve often said Biden will be on the ballot. There are many ways to accomplish, and the parliamentary change is not the only way to go. In fact, I felt quite sure that that was going to be the least possible path”, Russo said.

The Democratic Party refused to follow the state law that requires both parties to announce their presidents officially 90 days before an elections. “Democrats aren’t going to do that until 75 days before the election,” Nick Sortor, a journalist, said.

The statement comes amid pressure on Ohio lawmakers to amend the state law that sets strict dates for certifying presidential candidate for the November ballot. Ohio has set a deadline for each party to certify its presidential candidates by Aug. 7, so that they can appear on the general election ballot in November. The Democratic National Convention, the party’s procedural meeting where they decide on a nominee, is not until August 19. To allow Biden, the presumptive Democratic candidate, to appear on Ohio ballots, lawmakers would need to amend the Ohio law.
Stephens, a reporter for the Statehouse News Bureau, said on Tuesday that “it’s a hyper-political environment at this time.” “There were Republicans who did not want vote on it, and others who did.”
Ohio is not the only state that has such a law. Both Alabama and Washington have similar laws which would prevent Biden appearing on the November ballot of their state due to the date of the Democratic National Convention. Alabama lawmakers, however, passed a special law earlier this month that allowed the president to appear in the state’s November ballot regardless of deadlines. Washington lawmakers will allow Biden to also appear on the state ballot through a provisional certificate, as long as the Democratic Party submits a provisional nomination before the state deadline of August 20.

Stephens said that the legislature “just doesn’t have the will” to act.
