This Is What a Feminist Looks Like

Samuel Alito, the Supreme Court Justice who wrote the opinion that overturned Roe v. Wade in 2012, may have taken away women’s right to choose their own destiny and taken away their right to an abortion, while causing many to suffer near-death trauma. But he won’t tolerate a woman being prevented from flying a national flag.

Yet though flags frequently flying at both his Virginia residence and his New Jersey vacation home on January 6 in a letter to two Democratic senators on Wednesday, Alito said he would never recuse himself from cases involving January 6. The reason, Alito explains, is that his wife loves flying flags and it was all her idea. But he is not throwing Martha- Ann Alito under the bus: As Alito explains, he ca n’t control his wife, nor should he. She has a right to fly flags.

The letter comes after the New York Times reported earlier this month that an upside down US flag, a symbol of support for Donald Trump’s” stop the steal” movement, flew outside Alito’s Virginia home in the days before President Joe Biden’s 2021 inauguration. Senators Dick Durbin of Illinois and Sheldon Whitehouse of Rhode Island, who simultaneously called on Alito to recuse himself from cases involving the 2020 election, including a significant one in which former president Trump seeks legal immunity for his role in trying to overturn his defeat, wrote to him.” As soon as I saw it, I asked my wife to take it down, but for some days, she refused,” Alito wrote. When the court issues its ruling in the forthcoming weeks, Democratic- appointed justices, including Alito, may thwart Trump’s prosecution for his attempts to steal the 2020 election.
” My wife and I own our Virginia home jointly”, Alito’s letter continues. Thus, she is legally permitted to use the property as she pleases, and there are no more steps I could have taken to have the flag removed sooner.
Alito’s wife has a mind of her own, and she owns property, Alito reminds the senators. Who is he to prevent her from? ” She makes her own decisions, and I have often respected her right to do so”, Alito wrote. Alito is n’t blaming his wife. He’s honoring her rights.
Next week, the Times reported that a minute pro- coup flag had flown at Alito’s vacation home. The” Appeal to Heaven” flag, originally associated with America’s war of independence, has come to signify support for Trump and was hoisted by rioters on January 6. Christian nationalists who see Alito as their champion on the Supreme Court have likewise popularized it on the right. The court was deciding whether to pursue a case pending before the court over what charges might be brought against January 6 rioters at the time the flag flew at the Alito’s vacation home in August of 2023.
Alito once more denounces the improperness of this flag’s flying over his home as another instance of a feminine property owner who values her property and exercises her rights. ” My wife is an independently minded private citizen”, Alito wrote. ” She makes her own decisions, and I honor her right to do so”. She remarked,” Our vacation home was purchased with money she inherited from her parents and has her name on it. It is a place, apart from Washington, where she should be allowed to relax”.
In fairness, this is not the first time Alito has dabbled in feminism. As he noted in his decision in Dobbs v. Jackson Women’s Health Organization, overturning Roe v. Wade:
Women have a lot of social and electoral power. It is interesting to note that the proportion of women who register to vote and cast ballots continuously outnumbers the proportion of men who do so. In the next election in November 2020, women, who make up around 51.5 percent of the population of Mississippi, constituted 55.5 percent of the voters who cast ballots.
Because this is a woman’s world and Alito is only living in it, Alito quickly omitted that the Mississippi legislature that passed the abortion ban at issue in Dobbs was 86 percent male. No, women ca n’t have abortions or make life- altering decisions about their future. However, he will defend their right to fly any flag they choose on a home if they are the owners.
