ACLU Sues Biden Administration Over ‘Unilateral’ Ban On Asylum Seekers

President Joe Biden’s decision to implement these plans came after criticizing Republicans for blocking a bipartisan border agreement in February. The recent executive order bans migrants at the border from receiving asylum when the system is deemed to be “overwhelmed” according to the White House’s new guidelines. The White House had been planning the decision for months, as immigration policy is expected to be a key issue in the upcoming November election. The ACLU, along with other civil rights groups, filed a lawsuit against Biden’s actions, drawing comparisons to the actions of former President Donald Trump that were stopped by federal courts. Lee Gelernt, deputy director of the ACLU’s Immigrants Rights Project, stated that they had no choice but to take legal action. The administration does not have the sole power to disregard Congress and prohibit asylum based on the method of entry into the country, which was clearly established by the courts when the Trump administration attempted a similar ban and was unsuccessful. We are taking legal action against the Biden administration for implementing executive orders that greatly limit asylum and endanger many lives. These orders are reminiscent of the asylum ban implemented by the Trump administration, which we previously fought and won in court. The White House denied those claims in a statement on Wednesday evening, restating that the president had to act when the GOP prevented attempts to increase border security and funding. A White House representative explained that the Biden-Harris administration made these decisions within their power because border encounters continued to be too high, and Congressional Republicans had twice rejected a bipartisan border security agreement that would have offered essential resources, legal changes, and more personnel to the border. The authorities will keep enforcing our immigration laws, and individuals who do not have a legal right to stay in the United States will be taken out.
