If Trump’s attorneys had n’t argued that the affair always occurred, how the prosecution’s New York criminal trial against him for receiving hush money from Daniels would have ended. Trump has long maintained that the porn star’s account of the alleged sexual encounter—along with past Playboy model Karen McDougal’s story of an affair with Trump—were misleading. He had not, however, tried to persuade a jury before.
In this context, let’s consider how the Manhattan DA’s office could demonstrate that Trump allegedly fabricated 34 felonies through the use of business records in an attempt to break state election interference laws. That state election law prohibits the use of “unlawful means “—that is, the violation of even more laws—to influence an election. That’s all quite complex.
At the outset of the trial, some people understood the case against Trump, let alone assumed he was guilty. But almost everyone, likely including the jurors, assumed he slept with Daniels and McDougal. Simple.
And still, Trump’s lawyers, in their opening and closing statements, asked jurors to believe that Trump did not have sex with those women. They made the effort to demonstrate that the complex case had been fabricated in a significant way.
But Trump’s lawyers did n’t have to do that. Illicit sex is n’t a crime. They could have simply argued that regardless of the details of those relationships, or what jurors might think of the former president, hush money payments are n’t themselves illegal. They could have argued that the prosecution had not made the multi-part crime they claimed was distinct enough to warrant a conviction.
Those are good arguments, but Trump’s lawyers complicated it—possibly at their client’s behest—with a controversial and constitutionally unnecessary denial.
Jurors, experts say, typically decide cases based on whose story they believe. The jury can weigh more about whether the encounter actually took place and, if so, whether they choose to credit Ms. Daniels ‘ story, according to Merchan.
Daniels was left free to share under oath her account, initially reported by Mother Jones, of spanking Trump with a magazine.
Worse, Daniels suggested the encounter was never fully sexual. That testimony serves as a reminder that a distinct jury last year found Trump guilty of sexual assault against E. Jean Carroll, and the judge in that case has consistently argued that the jury’s verdict amounts to a finding that Trump had committed “rape,” as the term is commonly used.
