Elder Patriot’s Opinion – President Trump has been well served by his personal Special Counsel, Emmet Flood. Flood joined Team Trump in the late April-early May of 2018 timeframe. Flood has advised the president quite ably since he came on board.
Importantly, he convinced the president to keep his powder dry when it came to declassification.
With the conclusion of the Mueller Report, President Trump now holds all of the cards. Trump now holds the right of declassification over those who conspired against him like the Sword of Damocles. How the worm has turned.
Two weeks ago, Emmet Flood sent a letter to Attorney General William Barr castigating Robert Mueller for his blatant politicization of the Special Counsel Office:

The letter is only five pages in length but for those of you who can’t take the time to read it we’ll highlight some of the legal issues that Flood cites regarding his misuse of the Special Counsel statute by Robert Mueller:
- 28 CFR § 600.8 specifically states:
(c)Closing documentation. At the conclusion of the Special Counsel’s work, he or she shall provide the Attorney General with a confidential report explaining the prosecution or declination decisions reached by the Special Counsel.
- A.G. Barr did what his subordinate didn’t. He obeyed the governing statute, 28 CFR § 600.8 – Notification and reports by the Special Counsel.
Barr examined the lack of evidence, coupled that with the fact that Mueller neither made a criminal referral against President Trump, nor did Mueller seek an indictment, and he wrote a four-page summary that was still more than was necessary.
- By creating a new standard for American jurisprudence, an inability to prove innocence beyond a reasonable doubt, Mueller and his staff turned the SCO report into a political document.
Every citizen enjoys the presumption of innocence in our Constitutional Republic.
- If Mueller’s plan was to provide a “road map” for Congress, as House Judiciary Chairman Jerrold Nadler contends, then Mueller deliberately, and without legal justification, overstepped his mandate as an inferior Article II officer.
Only the president, the lone people’s representative voted on by the whole country, and the only elected member of the Executive Branch, has the authority to contemplate choosing to ignore the Separation of Powers.
President Trump chose to openly share and cooperate with the Special Counsel, as was his right. The Special Counsel is a part of the Executive Branch. Trump’s decision to cooperate with Mueller grants no such privilege to the a different branch of government.
In other words, President Trump’s personal Special Counsel, Emmet Flood has made it clear there will be no more cooperation from here on out.
