(Los Angeles, CA)— – Herring Networks, Inc., an independent, family owned national cable television programming company based in San Diego, California, filed a defamation lawsuit today in the United States District Court, Southern District of California, against Defendants Rachel Maddow, Comcast Corporation, NBC Universal Media, LLC, and MSNBC Cable LLC. The Complaint seeks damages in excess of $10,000,000.
Herring Networks owns and operates One America News Network (“OAN”), a prominent and popular independent television news channel providing Americans with a conservative alternative to the major liberal news outlets. The Complaint alleges that Comcast refused to carry OAN as part of its cable programming because OAN counters the liberal politics of its own channel, MSNBC.

OANN alleges that Comcast refused to carry OANN on their cable service because OANN “counters the liberal politics of its own channel, MSNBC.”
OANN’s President, Charles Herring sent an email to Comcast’s President of Content Acquisition, objecting to Comcast’s anti-competitive censorship.
Rachel Maddow opened her show telling her audience that OAN “really literally is paid Russian propaganda.”
OANN alleges that defendants knew this statement was demonstrably false and that, therefore, they acted in a reckless and malicious manner in order to damage the conservative news network.
Skip Miller, attorney for OANN, said:
“One America is wholly owned, operated and financed by the Herring family in San Diego. They are as American as apple pie. They are not paid by Russia and have nothing to do with the Russian government. This is a false and malicious libel, and they’re going to answer for it in a court of law.”
The defendants are liable on at least two legal fronts:
-Damages for defamation due to Maddow, “maliciously and recklessly” smearing the network as a Russian state propaganda outlet.
-Under Section 230 of the Communications Decency Act, cable systems enjoy immunity from liability for programming content as long as they operate as a neutral public forum.
In theory, as we understand it, as soon as the carrier engages in limiting and/or promoting political speech it loses that immunity and becomes liable for the content of the entirety of its programming.
Leftists’ obsession with tying everyone on the right to Russia, in an effort to regain power, is reminiscent of McCarthyism. From where I sit, it is way more dangerous than McCarthyism, as the entire leftist movement is parroting the “false narrative”, from the vast majority of the MSM to, politicians in the highest of offices.
Jennifer Rubin (Washington Post Columnist): “It’s not only that Trump has to lose, but that all his enablers have to lose — we have to collectively, in essence, burn down the Republican party. We have to level them because if there are survivors — if there are people who weather this storm, they will do it again.”
These aren’t the words of a political opponent, they’re the words of a journalist who, in my view, is clearly in the employ of the anti-Trump Globalist movement.
Only tyrants need to stifle dissent. And, that’s exactly what those on the anti-Trump left are engaging in.
Despite four thorough investigations – the FBI, the House Intelligence Committee, the Senate Intelligence, and the 22-month long inquest by a special counsel – that spanned at least three years, the media will not admit they backed the wrong horse, and are instead doubling down on their, IMHO, their over the top efforts to silence conservatives and bury their seditious reporting.
Maybe Sen. McCarthy was right.
