ast: The 3WHH at the Supreme Court on Affirmative Act Game Day // (Steven Hayward).
Monday’s Supreme Court hearing will focus on the affirmative action cases against Harvard and University of North Carolina. This is the Super Bowl of civil right litigation, and arguably the Court’s biggest moment since Brown V. Board of Education. This episode focuses on that topic. However, we briefly review some other key news stories from the week such as Fetterman’s collapse, the early spin about the deeply bizarre Paul Pelosi story and the growing confirmation of COVID lab leak theory. We also discuss the left’s anger at Elon Musk’s acquisition of Twitter.
The main story of the week is John Yoo-McDonald’s bad news announcement of a “farewell Tour” for his beloved McRibb. After which McDonald’s stock surged by more than 10%, it seems that Wall Street doesn’t care much about John’s culinary choices.
Then, we will preview some of the key issues that we hope to confront directly in oral argument. These include the proper understanding and application of the 14th Amendment, flaws in “diversity” in the dubious Bakke case, as well observations about how this case has been developing in the pre-game period.
