News Voter Analysis – Voters are split on SCOTUS, disapproval of Congress’ job performance overwhelmingly. In an election year where the Supreme Court was under fire from Democrats for its ruling overturning Roe v Wade’s validity, voters are divided on the court’s job performance. This contrasts with overwhelming disapproval of Congress’s job performance. According to the Fox News Voter Analysis Survey, 51% of voters nationwide approve of the Supreme Court’s performance, while 49% disapprove. 16% of those voters strongly approve, and 23% strongly disapprove. This year, the court was the center of attention for its June decision in Dobbs vs Jackson Women’s Health Organization. This case overturned 1973 Roe v Wade decision which established a constitutional right that allows abortion. Some of them renewed their calls for a radical overhaul of the court, including adding judges to it – a once fringe idea that gained traction among Democratic lawmakers and activists in recent years. These calls gained momentum under the Trump administration when Trump nominated three justices for the court. This shifted the court’s composition to the right. The most significant shift was made by Trump’s nomination, conservative Justice Amy Coney Barrett to succeed liberal Justice Ruth Bader Ginsburg in 2020. Ginsburg’s death occurred just months before the general elections. The Democrats demanded that Trump delay naming a justice until after election day, which Trump rejected. Proposals to pack the Court are widely considered unlikely to win the votes. Nevertheless, the disapproval expressed by voters was much stronger about how Congress is performing its job. The Fox News Voter Analysis Survey found 72% disapprove that Congress is doing its job. 28% agreed. Only 6% of respondents strongly approve of Congress’s handling of its job, while 39% strongly disapprove. Despite the overwhelming disapproval, Congress’ numbers are slightly better than 2020, where 76% of voters disapproved that Congress was doing its job.
