According to Reuters, U.S. District Judge William Hayes sided with a group of Californians, gun retailers, and gun rights organizations when he determined that the one-gun-a-month law did not fit within the country’s long tradition of gun control regulation.
To give the state time to file an appeal, the judge stayed his decision for 30 days.

Following the landmark ruling in New York State Rifle &, Pistol Association v. Bruen, which significantly expanded gun rights, the Supreme Court has just issued its most recent ruling deeming a state gun law to be illegal.
One of the organizations challenging the law, the Second Amendment Foundation, said to Reuters that the California law was a flagrant violation of the Second Amendment.
The right to acquire arms is intrinsic to the right to keep and bear arms, Sack said.
The California attorney general’s office, which defended the law, announced that it was reviewing the decision.
The law, which was updated to add more restrictions in 2021 and 2024, is intended to reduce the number of straw purchases of firearms, where one person purchases a gun for another person who may be prohibited from doing so themselves.

According to the Firearms Policy Coalition,” Defendants have not met their burden of producing a well-established and representative historical analogy” to the [one-gun-a-month ] law,” the opinion read.
According to the Court,” the Court therefore concludes that Plaintiffs are entitled to a summary judgment as to the constitutionality of the One Gun-A-Month ] law,” it continued.

The ruling is the latest in a series of high court decisions that have declared state gun laws unconstitutional. This follows the landmark decision by the New York State Rifle & Pistol Association v. Bruen which dramatically expanded gun rights.
Bill Sack, director of legal operations at the Second Amendment Foundation (one of the groups that is challenging the law), told Reuters the California law violated the 2nd Amendment.
Sack said that the right to own and carry arms is inherent in the right to keep them.
A spokesperson for the California Attorney General’s Office, which defended this law, said that it was reviewing the decision.
The law, which has been updated to include additional restrictions in 2021, and 2024, is intended to reduce the number of straw purchases, where one person buys an item for another who may not be allowed to purchase it themselves.

The court added, “The Court concludes that Plaintiffs have a right to summary judgment on the constitutionality [of the one-gun-a month] law under the Second Amendment.”
