The hush money case involves accusations that Trump manipulated his company’s documents to conceal the purpose of payments to his former lawyer Michael Cohen, who paid Stormy Daniels $130,000 in 2016 to keep quiet about an alleged affair with Trump. Trump pleaded not guilty to 34 felony charges of altering business records and has denied any sexual encounter with Daniels. His lawyers claim that the payments to Cohen were valid legal fees and not a part of any attempt to conceal information. In additional decisions made on Monday, Merchan refused a request from the defense to prevent Cohen, Daniels, and other important prosecution witnesses from giving testimony. He also once again dismissed the defense’s appeal to stop prosecutors from claiming that Trump was trying to unlawfully impact the 2016 election through the alleged hush-money plan, or that the National Enquirer helped in concealing negative stories about him through “catch and kill” tactics. Prosecutors argue that after the 2005 “Access Hollywood” tape was released and several women accused Trump of sexual assault, he became more determined to prevent negative stories from being published. This ultimately led to the hush-money deal with Daniels. Trump’s lawyers, however, claim that the “Access Hollywood” video is irrelevant to the trial about documents and accounting practices and should not be included.
