Republican Gov. Next month, Kevin Stitt signed House Bill 4156 into law, making it unlawful for illegal immigrants to enter Oklahoma.
” The Justice Department today filed suit against the State of Oklahoma to challenge House Bill 4156 ( HB 4156 ) under the U. S. Constitution’s Supremacy Clause and Foreign Commerce Clause”, the U. S. Department of Justice announced in a press release.
The federal government is given the power to control immigration and maintain our global borders by the Constitution. Pursuant to this authority, Congress has established a thorough immigration framework governing noncitizens ‘ entry, reentry and presence. Because HB 4156 is preempted by federal law and violates the U. S. Constitution, the Justice Department seeks a declaration that HB 4156 is irrelevant and an order enjoining the state from enforcing the law”, it continued.
According to Principal Deputy Assistant Attorney General Brian M. Boynton, Oklahoma cannot disregard the United States Constitution and settled Supreme Court precedent.
” We have brought this action to ensure that Oklahoma adheres to the framework for immigration regulation that was established by Congress,” he continued.

Stitt, state Attorney General Gentner Drummond, and state Department of Public Safety Commissioner Tim Tipton were named among the defendants in the lawsuit filed in the US District Court for the Eastern District of Oklahoma.
The new law against “impermissible occupation” goes into effect July 1.
A first offense would result in a misdemeanor charge that could result in a fine of$ 500 and a year in prison. Immigration suspects who enter the country improperly would be required to leave the state within 72 hours.
A second offense would result in a felony charge that could result in a$ 1,000 fine and up to two years in prison.
The Biden administration filed a lawsuit in Iowa in May over a law that permits state authorities to deport or deport immigrants from the US.
In January, the Biden Justice Department filed a lawsuit in Texas challenging a law that allows state authorities to deport, detain, and punish immigrants who enter the country between ports of entry.

Oklahoma officials were anticipating the governmental action because the Department of Justice had last week threatened to sue unless the state agreed never to follow the new law.
In response, Oklahoma Attorney General Gentner Drummond called the DOJ’s preemption argument “dubious at best” and said that while the federal government has large authority over immigration, it does not have “exclusive power” on the subject.
In a letter to the DOJ, Drummond wrote that” Oklahoma is exercising its parallel and comparable power as a sovereign state to address an ongoing public crisis within its borders through appropriate legislation.” More directly, Oklahoma is purporting to end the Biden Administration’s mess by using only constitutional means in its own backyard, and it will do so with stronger state penalties in addition.
Before it was put on hold by the three-judge panel of the federal appeals court, Texas was only allowed to carry out a law related to Oklahoma’s for a couple ambiguous hours in March. Republican Gov. Kevin Stitt has signed House Bill 4156, which makes it illegal for illegal migrants to enter Oklahoma.
The U.S. Department of Justice released a press statement stating that “the Justice Department filed suit today against the State of Oklahoma in order to challenge House Bill 4156” (HB 4156), under the U.S. Constitution Supremacy Clause as well as the Foreign Commerce Clause.
The Constitution gives the federal government authority to regulate immigration, and manage our borders internationally. In accordance with this authority, Congress established a comprehensive framework for immigration that governs noncitizens’ entry, reentry, and presence. The Justice Department is seeking a declaration of invalidity for HB 4156 and an order preventing the state from enforcing it because federal law preempts and violates U.S. Constitution.
“Oklahoma can’t ignore the U.S. Constitution or Supreme Court precedent,” said Principal Deputy Attorney General Brian M. Boynton.
“We brought this action in order to ensure Oklahoma adheres to both the Constitution and the framework adopted for immigration regulation by Congress,” he said.

The lawsuit, filed in the US District Court for Western District of Oklahoma listed Stitt, State Attorney General Gentner Drummond, and state Department of Public Safety commissioner Tim Tipton as defendants.
The new law against “impermissible occupancy” will come into effect on July 1.
A first offense is a misdemeanor, punishable with up to a year in prison and a fine of $500. Migrants who are convicted of illegally gaining entry to the US will be required to leave within 72 hours.
A second offense could result in a felony charge punishable by two years in jail and a fine of $1,000.
In May, the Biden Administration sued Iowa over a state law that allows state authorities the arrest of migrants who had been denied entry to the US or deported.
The Biden Justice Department sued Texas in January for a law that authorizes state authorities, to arrest, jail and prosecute migrants who enter the United States between ports of entry.

The federal action was anticipated, as the Department of Justice had warned Oklahoma officials that it would sue the state if they did not agree to not enforce the new law.
Oklahoma Attorney General Gentner drummond responded by calling the DOJ’s argument of preemption “dubious” at best and stating that the federal government does have broad authority on immigration but not “exclusive power”.
Drummond wrote to the DOJ that “Oklahoma exercises its concurrent and complimentary power as a sovereignty state to address a public crisis within its border through appropriate legislation.” “To put it bluntly, Oklahoma is cleaning the Biden Administration’s mess in its own backyard using only legal means – and will continue to do so resolutely by supplementing federal prohibitions on drugs with robust state penalties.” Drummond wrote in a letter to the DOJ.
A three-judge panel of a federal appeals Court allowed Texas to enforce a similar law to Oklahoma’s only for a few confusing minutes in March, before the law was halted. The panel heard arguments in April from both supporters of the law and its opponents. It will then issue a ruling on the constitutionality of the law.
