The Milwaukee Journal Sentinel reports:
Democrats who argued the long-standing practice of allowing voters to file ballots into locked, unmanned boxes made voting easier to do, were pleased with the 4- 3 decision. But, past presidents Donald Trump and Republicans, who claimed unsupportedly that absentee voting and the boxes were riddled with fraud, harshly criticized that process in 2020.
” Today’s decision does not require or require the use of municipal clerks.” In the majority opinion, Justice Ann Walsh Bradley wrote in the majority opinion,” It simply acknowledges what (state law ) has often meant: that clerks may lawfully use protected drop boxes in an exercise of their statutorily- conferred discretion.”
Election clerks in Wisconsin can use the ballot drop boxes for the Nov. 5 presidential election and the Aug. 13 republican primaries.
Justice Rebecca Bradley, a liberal, wrote in the dissent that the democratic majority “again forsakes the rule of law in an attempt to advance its political agenda”, citing the court’s earlier ruling tossing the state’s political maps.
The Wisconsin Supreme Court ruled that absentee drop boxes in the state are outlawed in July 2022. Drop boxes can simply be placed inside election offices, according to MJTruthUltra, according to the court.

The Democrat group Priorities USA filed a lawsuit specifically challenging the 2022 decision that curtailed the use of drop boxes as well as other rules and restrictions governing absentee voting after liberals won back the court majority in 2023. ( After a Wisconsin trial court narrowed the case, the group filed an appeal directly to the state Supreme Court, skipping over lower appeals courts. )
The group claimed that Wisconsin law is silent on the subject of drop boxes, which made it necessary for the 2022 decision to be made. The group raised the issue of whether absentee ballots can be returned in person to locations other than the clerk’s office, though the group acknowledged that Wisconsin laws do state that absentee ballots can be done by mail or in person.
The four liberal justices of the Wisconsin Supreme Court voted to accept the case, choosing only to decide whether the decision was made wrong and never on any other issues that were raised in the case.
Democrats and progressives in the state filed numerous briefs asking the court to overturn its 2022 decision, while liberal organizations and the Wisconsin Republican Party also filed numerous briefs in support of upholding the state’s latest drop box regulations.

The 4-3 decision was a victory for Democrats, who argued that the longstanding practice of allowing ballots to be filed into locked, unmanned boxes makes voting more accessible. This process was, however, heavily criticized by the former President Donald Trump in 2020, who claimed, without evidence, that the boxes and absentee balloting were rife.
“Our decision today doesn’t force or require any municipal clerks to use drop boxes.” It merely acknowledges what (state law) has always meant: that clerks may lawfully utilize secure drop boxes in an exercise of their statutorily-conferred discretion,” Justice Ann Walsh Bradley wrote in the majority opinion.
The decision made on Friday allows Wisconsin’s election clerks to use the ballot drop box during the Aug. 13 partisan primary and the Nov. 5, presidential election.
In the dissent, Justice Rebecca Bradley, who is conservative, said that the liberal majority had “once again forsaken the rule of law to advance its political goals,” citing a previous ruling by the court tossing out the state’s election maps.
“July 20, 2022, the Wisconsin Supreme Court ruled absentee dropboxes are ILLEGAL in Wisconsin. The court said that drop boxes could only be placed INSIDE of election offices,” MJTruthUltra reported.
“That’s now changed.. they will be everywhere again… —- The Wisconsin Supreme Court just yesterday reinstated the use ballot drop boxes in state,” he said.
This is a compilation of Detroit’s voting satellite centers in advance of the November 2020 elections. Individuals, and sometimes teams, were caught on camera placing STACKS of votes into these boxes… These Ballots have been counted. “No arrests,” he added.

Priorities USA, a Democratic group, filed a lawsuit in 2023 after liberals regained the majority on the court. The suit sought to overturn judicial rulings from 2022 that restricted the use of drop-boxes, as well other rules and restrictions pertaining to absentee balloting. After a Wisconsin trial judge narrowed down the suit, Priorities USA appealed directly the state Supreme Court without going through lower appeals courts.
The group argued that Wisconsin law was silent on the subject of drop boxes, and that the 2022 decision was incorrect. The group acknowledged that Wisconsin law does state that absentee votes must be returned in person or by mail, but they raised the issue that it was unclear whether voters could return absentees ballots to locations other than the clerk’s office.
The Wisconsin Supreme Court’s four liberal justices voted in favor of accepting the case. They agreed to only resolve if the ruling was incorrectly made, but not to address any other issues raised by the suit.
Democrats and progressives from the state filed a number of briefs urging that the court overturn its 2022 ruling, while conservative groups as well as the Wisconsin Republican Party submitted several briefs supporting the current rules on drop boxes.
The ruling could, however, encourage Republican efforts to adopt drop boxes in Wisconsin.
